SWEEPSTAKES RULES

NO PURCHASE NECESSARY. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY

1. Sweepstakes Period.
The Design Works Gaming Peloton Sweepstakes (the “Sweepstakes”) begins on October 4 at 12:00AM PST and ends on October 8 at 11:59PM PST (the “Sweepstakes Period”).

2. Sponsor.

The Sweepstakes is sponsored by Design Works Studios, LLC dba Design Works Gaming (the “Sponsor”).

3. Eligibility.

The Sweepstakes is open only to legal residents of the United States who are twenty-one (21) years of age or older at the time of entry (the “Entrant” or “Entrants”). Employees, independent contractors, and interns of the Sponsor and each of its affiliates, parent companies, subsidiaries, advertising and promotion agencies (including, in each case, immediate family members) are not eligible to enter the Sweepstakes. For purposes of this Sweepstakes, “immediate family members” is defined as spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household, whether or not related. In order to enter the Sweepstakes or win the Sweepstakes Prize, the Entrant must comply fully with these official rules (the “Rules”), and by entering agrees to be bound by these Rules and the decisions of Sponsor, whose decisions shall be binding and final in all respects.

4. Sweepstakes Prize.

The Original Peloton Bike.

The total approximate retail value of the Sweepstakes Prize is $1,895.00 USD. Any Sweepstakes Prize elements not specifically described in this Section may be determined by Sponsor, in its sole and absolute discretion. Winner is not guaranteed or entitled to have the ability to request or demand the Sweepstakes Prize elements that are not specifically stated in this section.

5. How to Enter; No Purchase Required.

Eligible persons may enter the Sweepstakes by providing their name, company name, title, and email address in the sweepstakes signup form. No purchase is necessary.

6. Additional Sweepstakes Rules.

All required information must be provided, or Entrant will be automatically disqualified.

a. One (1) entry per person.

b. Winner’s names will be released and Winner will be notified by email on or about October 15, 2021 (the “Drawing Date”).

7. Odds of Winning.

Odds of winning are based on the number of total entries. The Winner will be chosen at random.

8. Selection of Winner.

Sponsor will select the winner of the Sweepstakes (“Winner”) on the Drawing Date. The Winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Period. The selected Entrant will be contacted on or about the Drawing Date using the email address provided with the entry and will be awarded the Sweepstakes Prize subject to verification of eligibility and compliance with the terms of these Rules. Failure by Entrant to respond to the initial verification request will result in disqualification and Sponsor will select an alternate Winner in the same manner. In the event that a potential Winner is disqualified for any reason, Sponsor will award the applicable Sweepstakes Prize to an alternate Winner.

The Winner must sign an Affidavit of Eligibility, Liability and Publicity Release (the “Release”) in order to be eligible to accept the Sweepstakes Prize. In the event a Winner is disqualified for any reason, the Sweepstakes Prize will be forfeited and no compensation will be given. No substitution or transfer of any Sweepstakes Prize is allowed, except at the sole discretion of Sponsor. Sponsor reserves the right to substitute a Sweepstakes Prize of equal or greater value.

All local, state and federal taxes incurred by accepting a Sweepstakes Prize will be the sole responsibility of the Winner. The Winner may be announced in a future edition of the Sponsor newspaper. The decisions of Sponsor are final as to all matters.

9. Disputes.

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Sweepstakes Prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court for the District of Arizona or the appropriate State Court located in Maricopa County, Arizona; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (d) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada.

By entering, Entrants agree to comply with these Rules and the decisions of Sponsor, which are binding and final, and further agree to release Sponsor and each of its affiliates, parent companies, subsidiaries, advertising and promotion agencies and anyone associated with the production of this Sweepstakes, and their respective directors, officers, employees and agents (collectively, the “Released Parties”) from any and all liability for any claims, injuries, losses or damages (including attorney’s fees) of any kind arising out of their participation in this Sweepstakes or resulting from acceptance, possession, use or misuse of the Sweepstakes Prize. The Winner waives the right to assert as a cost of winning the Sweepstakes Prize any and all costs of verification and redemption or travel to redeem the Sweepstakes Prize and waives any liability or claims (including attorney’s fees) which might arise from redeeming or seeking to redeem the Sweepstakes Prize. In the event of non-compliance with these Rules, or if the Sweepstakes Prize is refused or cannot be accepted for any reason, the Sweepstakes Prize will be forfeited. Upon forfeiture or refusal, no compensation will be given.

Entrant agrees to defend, indemnify, release ,and hold harmless the “Released Parties from and against any and all claims, expenses, and liability, including without limitation, reasonable attorneys’ fees and legal expenses, which arise out of any third party claim, including but not limited to, negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, or death or personal injury arising out of or relating to an Entrant’s entry, creation, or submission, of an entry, participation in the Sweepstakes, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of the Sweepstakes Prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of the entry. The Sweepstakes Prize is awarded as-is without warranty of any kind.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Entrant’s registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes.

10. General.

Acceptance of the Sweepstakes Prize constitutes permission to use the Winner’s name, photograph, likeness and/or statements attributed to Winner regarding the Sweepstakes, for advertising and publicity purposes without further compensation or consent. All entries are works made for hire and become the property of Sponsor and may be used by Sponsor for any purpose without compensation.

This Sweepstakes shall only be construed and evaluated according to the laws of the state of Nevada, without regard to the principles of conflicts of laws, and submission of any entry constitutes acceptance of such laws. This Sweepstakes is void where prohibited. All federal, state and local laws and regulations apply.

Sponsor reserves the right, in its sole discretion, to disqualify and/or void any entries held by an Entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes.

No more than the stated number of Sweepstakes Prizes will be awarded.

All third party names and trademarks are the property of their respective owners. The Sweepstakes is not endorsed, affiliate, or sponsored by Peloton Interactive Inc. or its parents, subsidiaries, affiliates, officers, directors, or employees.
